1. INTRODUCTION
This agreement governs the use of services and products offered by Bally Bliss Aesthetic Clinic & Spa (“we”, “us”, “our”) by any client or customer (“you”, “your”, “client”). By booking, purchasing, or receiving treatment or consultations, you agree to be bound by these terms.
This policy ensures clarity on your rights and responsibilities under:
- Irish Consumer Law (Sale of Goods and Supply of Services Act 1980)
- GDPR (EU 2016/679)
- Health and Safety Authority (HSA) guidelines
2. BOOKINGS & DEPOSITS
- Appointments must be booked in advance online, by phone, email, WhatsApp, or in person.
- A minimum booking fee (10% deposit) is required. Deposits are non-refundable and non-transferable, except as outlined in our Refund Policy (Section 5).
- Bookings are only confirmed once the deposit is received and confirmation sent via SMS/email.
- Clients may be asked to complete an online pre-assessment form before treatment.
- The clinic reserves the right to refuse or reschedule bookings for medical, safety, or professional reasons.
3. ARRIVALS, LATENESS & NO-SHOWS
- Please arrive 10 minutes prior to your appointment.
- A 10-minute grace period applies; after this, appointments may be shortened or cancelled with deposit forfeited.
- No-shows or repeated lateness may result in blacklisting from future bookings.
4. CANCELLATION & RESCHEDULING
- Cancellations or rescheduling require at least 48 hours’ notice.
- 24–48 hours’ notice → deposit forfeited or €50 late fee.
- Less than 24 hours → full treatment cost charged or payable before future bookings.
- Rescheduling is subject to availability.
5. REFUND, EXCHANGE & CREDIT POLICY
Treatments:
- Refunds are not issued once treatments are performed, as results vary individually.
- Adverse reactions will be reviewed with supporting medical documentation; any refunds are discretionary and pro-rated.
Packages:
- Non-refundable once started.
- Unused sessions may be transferred with management approval.
Products:
- Refunds only if unopened/unused within 14 days, or if defective/damaged.
- Refunds processed to the original payment method within 14 working days.
6. CLIENT RESPONSIBILITIES & MEDICAL CONSENT
- All clients must be 18+ (photo ID may be requested).
- Children/under-18s are not permitted in the treatment room.
- Treatments cannot be performed if you are pregnant or breastfeeding.
- Clients must:
- Complete an honest medical history and consent form.
- Disclose all relevant conditions, allergies, medications, or past reactions.
- Follow all pre- and post-treatment instructions.
- Arrive with a clean face (no makeup, SPF, or skincare). A €10 removal fee applies if required.
- Avoid alcohol or blood-thinners 24 hours before injectable treatments.
- The clinic reserves the right to refuse treatment where not in the client’s best interest.
7. PHOTOGRAPHY & RECORD KEEPING
- Clinical photos are taken before/after treatments for medical documentation.
- Photos remain confidential unless written consent is given for marketing/social media.
- Your personal data (including health records) is stored securely under GDPR (see Section 11).
8. RESULTS DISCLAIMER
- Results vary depending on individual biology, age, lifestyle, and compliance.
- No results are guaranteed; before-and-after images are illustrative only.
- Maintenance treatments may be required for lasting results.
9. COMPLICATIONS & AFTERCARE
- All clinical procedures carry risks (bruising, swelling, allergic reactions, delayed healing, uneven results).
- Only CE-marked/FDA-approved products are used.
- Strict adherence to aftercare is required to minimise risks.
- Failure to follow aftercare may void eligibility for retreatment, refund, or complaint resolution.
10. TRAINING MODEL POLICY
- Some treatments may be carried out by trainees under supervision as part of Bally Bliss Academy.
- Training model treatments are at reduced cost, non-refundable, and require separate consent.
11. COMPLAINTS PROCEDURE
- Complaints must be submitted in writing to ballyblissclinic@outlook.com within 7 days of treatment.
- Include full name, date, treatment, and details of the concern.
- We will acknowledge within 5 working days and respond formally within 20 working days.
12. GDPR & DATA PROTECTION
We comply fully with GDPR. Data collected includes:
- Contact details, health records, appointment history, consent forms, and clinical photos.
- Data is used solely for safe and effective care and is never shared without consent.
- You may request access, correction, or deletion of your data at manager@ballyblissclinic.com.
13. GIFT VOUCHERS & PROMOTIONS
- Vouchers valid for 12 months and non-refundable.
- Lost/stolen vouchers cannot be replaced.
- Promotions/discounts cannot be combined unless explicitly stated.
- Offers subject to availability and may be withdrawn without notice.
14. BEHAVIOUR & SAFETY
- Abusive, disrespectful, or inappropriate behaviour toward staff will not be tolerated.
- We reserve the right to refuse service to anyone acting in a manner unsafe or disruptive to the clinic environment.
15. LIMITATION OF LIABILITY
The clinic shall not be liable for:
- Delays/cancellations due to events outside our control (e.g., pandemics, illness).
- Results not meeting expectations where due care was taken.
- Complications from undisclosed pre-existing conditions.
Liability is limited to cases of proven gross negligence or wilful misconduct.
16. GOVERNING LAW
This agreement is governed by the laws of Ireland. Disputes shall fall under the exclusive jurisdiction of the Irish courts.
17. AMENDMENTS
Policies may be updated without notice. The latest version will be available in-clinic and on our website.
18. ACKNOWLEDGEMENT
By booking or attending treatment, you confirm that you have:
- Read and understood this policy.
- Had the opportunity to ask questions.
- Provided accurate information to ensure safe care.
